PERFORMANCE MATERIAL

It is the responsibility of every director to clear all performances or pay the corresponding royalty fee. Musical Theatre Competitions of America, LLC is not responsible for actions taken against any participant who violates the copyright of a production.

STATEMENT OF LIABILITY

MUSICAL THEATRE COMPETITIONS OF AMERICA, LLC STATEMENT OF LIABILITY:

Musical Theatre Competitions of America, LLC is a three-day musical theatre festival for middle and high school students. The festival includes group and individual performances, masterclasses, workshops, and large production with a seated audience. Musical Theatre Competitions of America, LLC will be indemnified and held harmless against any/all liability that may result from attending and participating in this event. Musical Theatre Competitions of America, LLC acts only as agents for various companies whose services and accommodations are made available and accepts no responsibility, in whole or in part, for any personal injury liability, personal liability, physical damage, loss, accident, delay, or irregularity which may happen by default of any hotel, amusement park, restaurant, motor coach company, or person rendering any of the services included. No responsibility is accepted for any damage or delay due to illness, pilferage, labor disputes, machinery breakdowns, quarantine, governmental restraints, weather/natural forces, or other causes beyond their control. Musical Theatre Competitions of America, LLC also disclaims any responsibility for personal injury liability or personal liability and/or physical damage arising from acts of negligence of any member of a group attending a Musical Theatre Competitions of America, LLC. event. If it becomes necessary to cancel or alter events' schedules, such alterations or cancellations may be made. By registering for the competition, the school agrees to indemnify and hold harmless Musical Theatre Competitions of America, LLC and its officers, directors, employees, and agents from any financial liability or obligation incurred by either the school or any individual participant, and from any injury or damage to the person or property of others which any participant causes, or contributes to, while participating in a Musical Theatre Competitions of America, LLC. event. Each participant hereby agrees to indemnify and hold harmless Musical Theatre (cont.) Competitions of America, LLC. and its officers, directors, employees, and agents from any financial liability or obligation incurred by that individual participant and from any injury or damage to the person or property of others which that participant causes, or contributes to, while participating in a Musical Theatre Competitions of America, LLC. event. Schools or individuals registering, release Musical Theatre Competitions of America, LLC. and its officers, directors, employees, and agents from any causes of actions, claims, and damages of any kind, or nature, whatsoever, arising from any injury, loss, damage, cost, accident, delay, irregularity, or expense arising out of, or in any way connected with, the performance or operation of a Musical Theatre Competitions of America, LLC. program. Furthermore, Musical Theatre Competitions of America, LLC. disclaims all liability inactions resulting from the unlawful reproduction of scripts, lyrics, and/or musical scores. Any royalties or fees due to the licensing agency are the sole responsibility of the performing group. COVID 19: I am aware of the existence of the risk of participating in any Musical Theatre Competitions of America (MTCA) festival that may cause injury or illness such as, but not limited to, Influenza, MRSA, or COVID-19 that may lead to paralysis or death. With full knowledge of the risks involved, I hereby release, waive, discharge Musical Theatre Competitions of America, LLC, its officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any/all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19. I agree to indemnify, defend, and hold harmless the Organization from and against any/all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any/all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19. I am fully and personally responsible for my safety and actions while and during my participation, and I recognize that I may be at risk of contracting COVID-19.
